THIS CONTEST IS OPEN TO USA RESIDENTS AND MEXICO AND IS GOVERNED BY USA AND MEXICAN LAWS.

B - A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING
C - ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY

CONTEST PERIOD

1.1 The Contest begins on Saturday, April 1, 2023 at 8:00 a.m. Pacific Time (“PT”)
1.2 The Contest ends on Sunday, April 30, 2023 at 8 p.m. Pacific Time (“PT”) 1.3 (The “Contest Period”).

1.3 The contest for May 2023 begins on the first day of May 2023.

14 The contest for May 2023 ends on the last day of May 2023.

ELIGIBILITY

2.1 The Contest is open to all residents of USA
2.2 The Contest is also open to all residents of Mexico
2.3 To all residents of both countries who have reached the age of majority
2.4 in their province or territory of residence at the time of entry,
2.5 or/and who are at least eighteen (18) years old at the time of entry.
2.6 Employees of The Tikee ARE NOT eligible,
2.7 Also employees of other companies associated with the promotion of the Contest
2.8 and their respective parents, subsidiaries, affiliates,
2.9 and advertising and promotion agencies
2.10 as well as the immediate family (spouse, parents, siblings, and children)
2.11 and household members of each such employee ARE NOT eligible.
2.12 The Contest is subject to all federal, state, local and municipal laws of both countries
2.13 and all regulations of both countries, USA, and MEXICO.

HOW TO ENTER

3.1 NO PURCHASE NECESSARY.
3.2 To participate in this Contest you must create an account with thetikee.com.
3.3 If you do not have an Account, visit www.thetikee.com
3.4 and register in accordance with the enrollment instructions for a free Tikee account.
3.5 You will need a valid email account and a username.
3.6 Once you have a free account, and during the Contest Period,
3.7 You will need to upload a picture or a video to participate.
3.8 See specifications for picture and video below.
3.9 If you want, you can tell everyone that you have enter a picture or video to the contest.
3.10 when you do so, please use the following hashtag: #thetikee (the “Hashtag”).
3.11 Is not necessary to tell other people about your participation.
3.12 Telling other people about your participation will not gurantee or increase your chances of winning.

PICTURE AND VIDEO ENTRY SPECIFICATIONS

4.1 Your Contest Photo must comply with the following specifications (the “Photo Entry Specifications”):
4.2 Be your original creation, and be a photograph taken solely by you.
4.3 Reproducing, modifying, enhancing or altering a third party's pre-existing work
4.4 or photo does not qualify as your original creation;
4.5 Not violate the copyrights of any third party, including, but not limited to copyright.
4.6 For example, your Contest Photo must not defame, infringe or violate publicity or privacy rights of any person,
4.7 living or deceased, or otherwise infringe upon any person's, entity's or organization's
4.8 personal or proprietary rights, including but not limited to, intellectual property rights.
4.9 For greater certainty, your Contest Photo must not contain trademarks,
4.10 logos, or trade dress owned by anyone other than the Sponsor,
4.11 or advertise or promote any brand or product of any kind,
4.12 without express, written, prior permission of the trademark or brand owner;
4.13 Not have been published previously, or uploaded to any website,
4.14 such as facebook, Instagram, Twitter, TikTok, Pinterest or similar.
4.15 Not have been used commercially, submitted to another competition or contest, or won any other award;
4.16 Be in “good taste” and in keeping with the Sponsor’s brand image
4.17 and must not be explicit, offensive, obscene, or profane,
4.18 and must not be derogatory toward any ethnicity, race, gender, sexual orientation, religion, profession, or age group,
4.19 or promote any activities that may be unsafe or dangerous,
4.20 as determined by the Sponsor, in its sole and absolute discretion;
4.21 Not contain any commercial content that promotes any product or service;
4.22 Not defame, misrepresent or contain disparaging remarks about Sponsor or its products;
4.23 Not be false, inaccurate or misleading;
4.24 Not violate any law or regulation in any Country;
4.25 Not be libelous, threatening or harassing;
4.26 Not instigate others to commit illegal activities or violate human rights;
4.27 and Not contain any viruses, worms, or other interfering computer programming.
4.28 The photo you submit to the contest, can not be uploaded anywhere else
4.29 untill the contest, where your photo is participating, is over.
4.30 Your Contest Video must comply with the same discretion and rules as the picture or photo
4.31 with a few extra specifications such as:
4.32 Must not be more than fifteen (15) seconds long in duration.
4.33 Must be in English.
4.34 If you r video is in Spanish, it will go in to the foreing Video Category
4.35 Must not contain bad words, cursing, dialogue that promote violence
4.36 The Sponsor has the right to refuse any Picture or Video for any reason.

4.37 The month of May there will be no videos at all. Only photos.

LIMIT

5.1 Each participant can participate one (1) time only, in each category.
5.2 A total of six (6) entries per account, during the contest period.
5.3 You can participate in one (1) or in all categories of the contest.
5.4 And you can have One (1) Entry in each Category.
5.5 You can participate with a picture, as long as it meats the entry specifications.
5.6 Or you can participate with a video, as long as it meats the entry specifications.
5.7 or you can participate with pictures or videos,
5.8 but not a picture and a video, in the same category.
5.9 For greater certainty and the avoidance of any doubt,
5.10 you can only use one (1) Account to participate in the Contest.
5.11 One account per person with one valid email only.
5.12 And each person can participate in one or all categories.
5.13 If it is discovered that you attempted to enter more than once in the same category
5.14 during the Contest Period, then all your Entries will be void.
5.15 One person, can not usu multiple email to participate several times
5.16 One person can only use one valid email, and one valid account.
5.17 Use of any automated system to submit Entries is prohibited and will result in disqualification.
5.18 A maximun of six (6) Entries are permitted for one (1) User. One for each category.
5.19 BY SUBMITTING AN ENTRY, YOU ACKNOWLEDGE THAT YOUR ENTRY
5.20 (INCLUDING YOUR USERNAME AND EMAIL) MAY BE POSTED ON SPONSOR’S PROPRIETARY WEBSITE,
5.21 OR THETIKEE.COM WHERE IT MAY BE VIEWED, SHARED
5.22 (BY USERS AND VARIOUS OTHER INTERNET-BASED SITES)
5.23 AND COMMENTED ON BY THE SPONSOR AND THE GENERAL PUBLIC.

WINNER SELECTION

7.1 During the month of April 2023 or the CONTEST PERIOD,
7.2 users will have the opportunity to upload pictures and videos.
7.3 All the entries (Photos and/or Videos) that qualify,
7.4 will be avaliable to see in thetikee.com starting
7.5 Monday, May 1, 2023 at approximately 8:00 a.m.
7.6 and will be there for the entire month of MAY 2023
7.7 users and people in general will be able to see them.
7.8 but only "Qualifiying Judges" will be able to vote for their favorite.
7.9 During the Month of May, "qualifying judges" will have the opportunity to vote,
7.10 for their favorite picture or video in each category.
7.11 And will be able to Nominate a picture or video.
7.12 thetikee.com will keep track of the nominations and the votes,
7.13 The results will not be visible or avaliable until the day of the awards.
7.14 "Qualifying Judges" can nominate a maximun of five (5) pictures and five (5) videos,
7.15 In each category, a maximun of Thirty (30) votes or nominations.
7.16 each nomination will count as one (1) vote.
7.17 The Picture or Video with more votes wins.
7.18 There will be a total of six (6) winners.

QUALIFYING JUDGES

8.1 A Qualifying Judge is the only person that can vote and/or nominate a picture or video.
8.2 to become a Qualifying Judge you must complete the following rules:
8.3 Have a valid account and be officialy register with thetikee.com
8.4 Be eighteen (18) years old or older at the time of voting
8.5 Using the same criteria as the Academy for the Oscars,
8.6 a Qualifying Judge can only vote for an area they know, and they are participating
8.7 and the Qualifying Judge must be participating in the contest themselves
8.8 To nominate a picture, or to vote for a picture,
8.9 in the Best Picture Of The Month in the Category of: DOGS
8.10 A Qualifying Judge, must first; Upload a picture in the Category of: DOGS
8.11 To nominate a video, or to vote for a video,
8.12 in the Best Video Of The Month in the Category of: DOGS
8.13 A Qualifying Judge, must first; Upload a video in the Category of: DOGS
8.14 And the same rules apply for all six (6) Categories.
8.15 To vote, the Qualifying Judge must use their own criteria of
8.16 what the Qualifying Judge thinks is the best picture or video.
8.17 As soon as one Qualifying Judge votes for a picture or video 8.18 That picture or video will have a nomination to win a TIKEE 8.19 a nomination is also an honor, because not every one will receive one. 8.20 The Qualifying Judge cannot be influenced by anyone,
8.21 cannot be manipulated, bribe, extortionated,
8.22 or in any form lead or force to vote for anyone
8.23 other than what the Qualifying Judge beleives is the best of the month.
8.24 Thetikee.com has no authority whatsoever in knowing
8.25 who will each particular Qualifying Judge will vote for.
8.26 If a Qualifying Judge is misusing their privilage to vote or nominate an entry
8.27 The Tikee has the right to cancel or refuse a privilage of a Qualifying Judge.
8.28 An all of their previous votes and nominations will be declare invalid.

WINNER ANNOUNCEMENT

9.1 The winner will be announced on the next month after voting.
9.2 one (1) eligible entrant will be announced for each category.
9.3 In thetikee.com official website will be shown,
9.4 in the winnwers section and announce the winner or winners.
9.5 The amount of votes and nominations each picture or video received
9.6 will be reveal and visible to all public in general.
9.7 The picture or video with more votes will be the winner
9.8 For example there will be thise statements of winners:
9.9 "The Best Picture Of The Month" in the Category of DOGS and have won a Tikee.
9.10 "The Best Video Of The Month" in the Category of DOGS and have won a Tikee.
9.11 "The Best Picture Of The Month" in the Catecory of VARIETY and have won a Tikee.
9.12 "The Best Video Of The Month" in the Catecory of VARIETY and have won a Tikee.
9.13 The winner picture or video will remain visible and accecible to all in thetikee.com
9.14 Before being declared a winner:
9.15 The selected entrant with the most votes will be contacted by private email message.
9.16 and notified that they are eligible to win.
9.17 The selected entrant must reply by private email message within three (3) business days
9.18 of notification and provide the Sponsor with a contact phone number.
9.19 The selected entrant must first correctly answer
9.20 a time-limited mathematical skill-testing question to be administered by telephone.
9.21 for one of the authorized personal of thetikee.com
9.22 The Sponsor or thetikee will then email the selected entrant,
9.23 and the selected entrant will be required to sign and return within three (3) business days
9.24 of notification a declaration of eligibility and a liability/publicity release, which:
9.25 confirms compliance with the contest rules;
9.26 releases the Sponsor and the tikee, its affiliated companies and agents,
9.27 advertising and promotion agencies, the contest Qualifiying Judges
9.28 and each of their respective officers, directors, agents, representatives,
9.29 successors and assigns from any liability in connection with the Contest,
9.30 the entrant’s participation therein and/or
9.31 the awarding and use or misuse of the prize or any portion thereof;
9.32 and grants to the Sponsor and/or thetikee the right to use the selected entrant’s name,
9.33 address and likeness, as well as their face,
9.34 in any form of advertising relating to the contest without further notice or compensation.
9.35 If a selected entrant: Cannot be contacted
9.36 by private email message within ten (10) calendar days of selection
9.37 or there is a return of any prior notification as undeliverable;
9.38 fails to correctly answer the skill-testing question;
9.39 or fails to return the contest documents within the specified time,
9.40 the email on file is not valid or no longer belongs to the entrant
9.41 then he/she will be disqualified and will forfeit the prize,
9.42 and the Sponsor and the tikee reserves the right to select an alternate
9.43 entrant from among the remaining eligible entries.

PRIZES

10.1 THE ODDS OF WINNING DEPENDING ON THE NUMBER OF ELEGIBLE ENTRIES RECEIVED.
10.2 A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
10.3 The winner of each category will receive one TIKEE
10.4 a TIKEE is a symbolic AWARD, to recognize the BEST PICTURE OR VIDEO IN EACH CATEGORY
10.5 a TIKEE is an award granted by thetikee.com only,
10.6 and can not be won by any other mean other than participating in the tikee contest.
10.7 The tikee has a CASH PRICE AWARD and a SYMBOLIC IMPORTANCE AWARD.
10.8 It's an honor to win a TIKEE. It builds reputation and respect,
10.9 and can greatly increase a sense of achievement for an individual,
10.10 and the entrant who wins a tikee will have something to show for, like winning an Oscar.
10.11 The CASH VALUE PORTION of an award will be of $50.00 to the winner per each category.
10.12 With a total prize for the six categories of $300.00 US Dollars
10.13 or the equivalent on MEXICAN PESOS for the country od MEXICO
10.14 One person can win in the category of DOGS, $50.00 and in the category of VARIETY, $50.00
10.15 One entrat could possibly win more than one prize.
10.16 Once the Entrant is legally accepted and declared winner of the month.
10.17 thetikee.com has Fifteen (15) days from the day the winner was announced,
10.18 or untill the end of JUNE, 2023, to give them the money.
10.19 Which can be paid, by check, money order, paypal or Zelle.
10.20 Once the winner receive the prize (Money) the contest will end.
10.21 Prizes must be accepted as awarded and are not transferable.
10.22 Prizes will only be awarded to the person who is the owner of the Account.
10.23 And has a valid thetikee.com account.

10.24 The prize for May 2023, will be $75.00

IN GOOD FAITH

11.1 THE TIKEE and THE SPONSONR SONGNES have done everything in their knowledge
11.2 and every effort in their part, to keep this contest fair, and lawfull
11.3 and to comply with all regulations and laws of USA and MEXICO
11.4 If there is a Typo, or misunderstanding of any source
11.5 or there is some legal laws that will prevent this contest to be realize
11.6 The person that finds the Typo, or is not clearly understanding the rules
11.7 Please contact us as soon as possible to fix the situation.
11.8 Or if the FTC or any other agency finds this contest not valid
11.9 The Tikee and The Sponsor will not be hold liable or accused of any wrong doing
11.10 the only remedy will be to CANCEL and/or SUSPEND the contest
11.11 and all PRIZES will be cancel.

HOW TO VOTE

12.1 Only Qualifying Judges can vote
12.2 From all the entries in each category,
12.3 the Judge or judges will choose five (5) Pictures or videos
12.4 Each of those five (5) pictures or videos will be nominated to win a TIKEE
12.5 Out of those five (5) nominations, then judge will vote for their final one.
12.6 Each judge or judges will then have 4 nominations and one VOTE for their favorite
12.7 The picture or video from a valid category that has the most votes, win a TIKEE
12.8 If there is a TIE, then BOTH participants will win a TIKEE
12.9 and will share the honor of receiving a TIKEE
12.10 and the MONEY VALUE will be the same for both of them
12.11 50% for one, and 50% for the other

GENERAL PART I

13.1 By entering the Contest, each entrant agrees to abide by these Contest Rules.
13.2 This Contest is subject to all applicable federal, provincial and municipal laws.
13.3 Void where prohibited by law.
13.4 The decisions of the Sponsor with respect to all aspects of this Contest are final.
13.5 And are binding on all entrants without right of appeal.
13.6 Sponsor reserves the right to cancel, suspend, withdraw or amend this Contest in any way,
13.7 without prior notice or obligation for anyone.
13.8 in the event of an error, technical problem, computer virus, bugs, tampering,
13.9 unauthorized intervention, fraud, technical failure or any other cause
13.10 beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest
13.11 as contemplated by these Contest Rules.
13.12 Any attempt to deliberately undermine the legitimate operation of this Contest
13.13 is a violation of criminal and civil laws and should such an attempt be made,
13.14 the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law,
13.15 including criminal prosecution.
13.16 You must warrant that your Contest Photo meets the Photo Entry Specifications, set out above.
13.17 Sponsor reserves the right to deem ineligible and exclude from the Contest
13.18 any Contest Photo that Sponsor, in its sole and absolute discretion,
13.19 determines does not meet the Photo Entry Specifications.
13.20 Your right to submit a Contest Photo or video must not be restricted in any way.
13.21 You must be able to provide legal releases for use of your Contest entry by Sponsor in any format,
13.22 and materials related to the Contest, including in relation to any third party’s name,
13.23 likenesses or work ("Third Party Elements") included in your Contest Entry.

GENERAL PART II

14.1 Sponsor’s right to use your Contest Photo or Video:
14.2 You acknowledge that your Contest Photo or video will appear in thetikee.com website
14.3 after it is posted and may appear in other electronic and print materials related to the Contest,
14.4 including promotional materials.
14.5 By posting a Contest Photo or video using our method to upload,
14.6 you irrevocably, perpetually, and without limitation,
14.7 grant Sponsor the right to use, publish, adapt, sub-license, edit, dispose of,
14.8 and/or modify such Contest Photo or video
14.9 in commerce, and in any and all media worldwide
14.10 in electronic and print materials related to the Contest,
14.11 and waive all your rights, including moral rights, in the Contest Photo or video,
14.12 without notice or extra compensation, and agree that you may be required to sign a release to that effect.
14.13 All Entries are subject to verification at any time and for any reason.
14.14 The Sponsor reserves the right, in its sole and absolute discretion,
14.15 to require proof of identity and/or eligibility
14.16 in a form acceptable to the Sponsor – including, without limitation, government issued photo identification:
14.17 for the purposes of verifying an individual’s eligibility to participate in this Contest;
14.18 for the purposes of verifying the eligibility and/or legitimacy of any Entry entered (or purportedly entered)
14.19 for the purposes of this Contest; and/or
14.20 for any other reason the Sponsor deems necessary, in its sole and absolute discretion,
14.21 for the purposes of administering this Contest in accordance with these Rules.
14.22 Failure to provide such proof to the satisfaction of the Sponsor
14.23 in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor.
14.24 The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

GENERAL PART III

15.1 Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise,
15.2 illicit means to enter the Contest, or any other methods not authorized by these Contest Rules,
15.3 for example, but not limited to, creating multiple Tikee accounts,
15.4 shall be deemed as tampering and may disqualify you from entering,
15.5 participating, winning prizes (defined herein),
15.6 and preclude you from participating in future contests and promotions,
15.7 at the sole discretion of Sponsor.
15.8 Entries that are late, lost, stolen, illegible, contain false information,
15.9 are damaged, misdirected, mutilated, garbled or incomplete,
15.10 altered or otherwise irregular or that do not conform with
15.11 or satisfy any or all of the conditions these rules will be judged void.
15.12 All Entries become the property of Sponsor upon receipt and none will be returned.
15.13 Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt.
15.14 Without limitation, the Sponsor, its advertising and promotion agencies
15.15 and the Contest judges will not be liable for any failure of the website during the Contest;
15.16 for an technical malfunction or other problems relating to the telephone network or lines,
15.17 computer on-line systems, servers, access providers, computer equipment or software;
15.18 for the failure of any Entry to be received by the Sponsor,
15.19 its advertising and promotion agencies or the Contest judges for any reason
15.20 including, but not limited to, technical problems or traffic congestion on the Internet or at any website;
15.21 or any combination of the above. Further, the Sponsor, its advertising and promotion agencies
15.22 and the Contest judges will not be liable for any injury or damage to an entrant’s
15.23 or any other person’s computer related to or resulting from participating
15.24 or uploading any material in the Contest.

GENERAL PART IV

16.1 In the event of a dispute, Entries will be deemed to have submitted by the authorized account holder
16.2 of the email address submitted at the time of entry.
16.3 “Authorized account holder” is defined as the person who is assigned an email address by an internet provider,
16.4 online service provider, or other organization (e.g. business, educational institute, etc.)
16.5 that is responsible for assigning email addresses for the domain associated with the submitted email address.
16.6 If the identity of an online entrant is disputed,
16.7 the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant.
16.8 A selected entrant may be required to provide proof that he/she is the authorized account holder
16.9 of the email address associated with the selected Entry.
16.10 The sole determinant of the time for the purposes of a valid online Entry
16.11 in this Contest will be the Contest server machine(s)
16.12 By entering this Contest, each entrant expressly consents to the Sponsor,
16.13 its agents and/or representatives, storing,
16.14 sharing and using the personal information submitted with his/her Entry
16.15 only for the purpose of administering the Contest and in accordance with Sponsor’s Privacy Policy
16.16 available at: Privacy Policy unless the
16.17 entrant otherwise agrees to receive further communications from Sponsor.
16.18 And agree to our Terms And Conditions to use our site.
